1. Scope and definitions

These terms apply to the use of the Kita Bus Berlin website and to expressions of interest in the planned pilot.

  • “We” means the operator named in the imprint.
  • “Caregivers” means people with parental responsibility or an equivalent authority.
  • “Enquiry” means an interest, quote or partnership request submitted through the website.
  • “Transport agreement” means a separate, explicit agreement about specific journeys.

2. Identity of the service provider

The provider is Pending: to be supplied by the operator before publication.. Full details are in the imprint.

3. Nature of the pilot

The website currently accepts expressions of interest only. Submitting a form does not create a transport agreement.

An enquiry gives no entitlement to a seat, a particular route, a particular price or a particular start date.

4. Eligibility and registration

Enquiries may only be submitted by adult caregivers or by an authorised representative of a Kita. Information provided must be accurate and current.

Before any journey we confirm individually whether participation is possible. Changes to addresses, pick-up points, authorised people or contact details must be reported to us without delay.

5. Formation of a transport agreement

A transport agreement is formed only when we make you a specific offer and you accept it in text form. Scope, times, pick-up and drop-off points and charges are set out there in binding form.

6. Service areas and route planning

The corridors shown on the website are planned service areas. Exact stops and routing are set according to the actual demand of families and Kitas and confirmed individually.

7. Pick-up, drop-off and authorised handover

Children are handed over only at agreed points and only to people named in advance as authorised, or to the staff of the agreed Kita.

A caregiver or a named authorised person must be present at the agreed place and time. If nobody is present, the child stays in our care, we contact you and agree the next step.

8. Roles on board and child restraints

A driver and a trained on-board guardian are planned for each journey. The guardian is responsible for boarding, alighting, securing children and the handover.

Children travel in age appropriate restraint systems. Where a child cannot be secured safely in an individual case, transport may be refused.

9. Health, accessibility and emergencies

Necessary information about health, allergies, medication or support needs is collected separately before journeys start and shared only with the people operating the journey.

In an emergency we call the emergency services and inform caregivers without delay.

10. Schedules, delays and route changes

Departure and arrival times are planned times. Traffic, weather, roadworks and other external circumstances can cause deviations. We inform you about material changes as early as possible.

11. Notifications

Planned pick-up and arrival notifications are an additional service. Delivery depends on the network, the device and system settings and cannot be guaranteed.

12. Prices, payment and invoicing

Prices, billing intervals, payment methods, cancellation and refund rules are not yet decided and will only be published here once they are confirmed.

13. Absence, cancellation and termination

Cancellations of individual journeys should be reported as early as possible so the route can be adjusted. Deadlines and consequences are set in the individual offer.

We may suspend or end transport where safety rules are repeatedly broken, required information is missing, or safe transport is not possible.

14. Behaviour and safety rules

Instructions of the driver and the on-board guardian must be followed. Children stay seated and secured during the journey.

15. Liability, insurance and force majeure

We are liable in accordance with statutory provisions. For injury to life, body or health and for intent and gross negligence, statutory rules apply without restriction; there is no blanket exclusion of liability.

We are not liable for events outside our control such as natural events, strikes or official orders. Details of insurance cover will be added once the contracts are concluded.

16. Complaints, data protection and dispute resolution

Please send complaints to the contact address in the imprint. We confirm receipt and come back to you with a response.

Information about the processing of personal data is in the privacy policy.

Participation in consumer dispute resolution: Pending: to be supplied by the operator before publication.

17. Applicable law, amendments and version

German law applies. Mandatory consumer protection rules of the country where you habitually reside remain unaffected.

We announce changes to these terms before they take effect. The version and date shown above apply.

This version is a draft and will be reviewed by a lawyer qualified in German law before any commercial launch.
